Those establishments providing Acute psychiatric care, Quarter way home, Halfway homes, Child psychiatric services and Geriatric Psychiatric services along with Centres providing substance use disorder treatment and rehabilitation services should be registered as MHE.

Registration of HPSMHA will be as per the provisions of Section 65 of Mental Healthcare Act, 2017.

Yes, as per MHCA, 2017, it is the duty of the MHE to fulfil the quality and service provision norms. The State Mental Health Authority can authorise an Audit of MHE under Section 67 of MHCA, 2017.

Yes as per the definition of MHE mentioned in Section 2 (p) of MHA, 2017, General Hospitals providing psychiatric Facilities are also included as MHE.

The process of inspection and audit is as per Section 67 of MHCA, 2017.

As per MHA, 2017 all grievances related to care, treatment and services in a MHE are addressed by Mental Health Review Board and currently six district medical review boards have been constituted to address the grievances pertaining to the Mental Health establishments in their jurisdiction.

As per definition mentioned in Section 2 (P) in the Act, outpatient psychiatric services do not come under the purview of the definition of Mental Health Establishment.

Yes, the composition of HPSMHA, includes persons with mental illness, caregivers, and organizations representation caregivers including NGOs. This is the first time in the law that representatives from users and carer groups are included in the composition of HPSMHA.

As per Chapter 8, Section 46 (L) of Mental Health Care Act – 2017, the State Government will advertise in two daily newspaper (one English and one Hindi) having wide circulation in the State and the Advertisement will be made available in the website of the Department of Health. Following which the Selection committee will nominate the members of SMHA.

As per Section 55 (1) (d), clinical psychologists, mental health nurses and psychiatric social workers in the State to work as mental health professionals will require to be registered with SMHA.
